Prosecutors Ask Judge to Dismiss Domestic Violence Murder Case

The case against twenty-two-year-old Asia Dontrese Moore was dismissed Friday by Judge John Ramsey Johnson; Moore had been suspected in connection to the stabbing death of her boyfriend Marvin Harvey.

"The U.S. Attorney’s Office moved to dismiss the case without prejudice after determining that there was insufficient evidence to go forward at this time," explained spokesman Bill Miller via email on behalf of the U.S. Attorney’s Office.

On July 3, 2013, Harvey, 23, was found unconscious, lying on the basement floor of a home on the 4000 block of Blaine Street Northeast. He was suffering from a stab wound to his left chest. Moore was arrested that same day and charged with first-degree murder.

According to charging documents Moore told police Harvey was punching her face and kicking her body, before she grabbed a knife from the upstairs kitchen. She told police she went back downstairs and said to Harvey, “Do not hit me, I’m not playing,” according to police.

Harvey then charged at her, and Moore swung the knife, stabbing him in the left chest, according to arrest documents.

During a preliminary hearing on July 15, 2013, defense attorney Janet Mitchell argued that the stabbing was justified and reasonable.

“If someone is hitting you and not stopping, I think it’s reasonable to push out with the weapon,” Mitchell said.

Probable Cause Found in Marvin Harvey Death, Asia Moore Released From Jail

Judge John Ramsey Johnson found probable cause Monday that Asia Moore stabbed and killed 23-year-old Marvin Harvey. Moore, though, has been released from jail on a personal promise to attend all scheduled court hearings.

On July 3, police found Moore, 22, with her boyfriend, Harvey, who was unconscious on the basement floor of a home on Blaine Street Northeast.

Charging documents in the case say Moore told police that she was doing Harvey’s hair in the basement when the two began to argue. Harvey got upset and began punching Moore in the face and kicking her in the body, she said.

Moore then grabbed a knife from the upstairs kitchen and went back downstairs and told Harvey, “If you hit me again, I’m going to stab you,” documents say.

Harvey then charged at her, and Moore swung the knife, stabbing him in the left chest, according to arrest documents.

But Metropolitan Police Detective Brian Bradol testified Monday that the arrest documents are incorrect.

After reviewing Moore's statement, Detective Bradol testified that Moore did not threaten to stab Harvey with the knife. Moore said, "Do not hit me, I'm not playing," Bradol told the court.

Arrest documents also say that after the stabbing Moore waited 30 minutes before calling police. Detective Bradol testified, though, that he wasn't sure how they arrived at that figure. He said it came "half from an ambulance crew."

Janet Mitchell, Moore's defense attorney, argued that the stabbing was justified and reasonable.

"If someone is hitting you and not stopping, I think it's reasonable to push out with the weapon." Mitchell said.

Mitchell further argued that Moore meant no ill-will toward Harvey. Mitchell said that Moore returned downstairs not to confront Harvey, but because she wasn't dressed properly and she wanted to collect her things. After the stabbing, Moore rendered first-aid, and then called police after Harvey lost consciousness, Mitchell told the court.

Judge Johnson explained his probable cause ruling by saying, "[There was] a six-inch blade plunged into the decedent's chest in circumstances that should've told Moore that the wound would be dangerous."

The case is scheduled for a felony status conference October 11.

Asia Moore Held in Connection with Stabbing Death of Marvin Harvey

Asia Moore was ordered held Thursday on a charge of second-degree murder while armed pending a preliminary hearing scheduled for July 15, in connection with the stabbing death of 23-year-old Marvin Harvey.

Arrest documents state that on July 3 police responded to a home on Blaine St. in Northeast DC at 2:22 p.m. They found Moore, 22, with her boyfriend, Harvey, who was unconscious and laying on the basement floor.

Moore told police that she was doing Harvey's hair in the basement when they began to argue about phone calls that were on her phone to another man. Harvey got upset and began punching her in the face and kicking her in the body, she said.

Moore said she ran to the kitchen, grabbed a knife and said, "If you hit me again I'm going to stab you."

Harvey charged at her, and Moore blocked his attempt to punch her in the face. Moore then swung the knife, stabbing Harvey in the left side of is chest, she said. He was unarmed.

After being stabbed, Harvey complained that he couldn't breathe, Moore said she didn't believe him at first, and made "other phone calls," waiting 30 minutes before calling the police.

Harvey was taken to Prince George's County Hospital where he was pronounced dead that same day at 3:06 p.m.

Police say Moore had a bite mark on her arm, but no other visible injuries were found.

Asia Moore Arrested in Connection with Stabbing Death of Marvin Harvey

A man fatally stabbed in Northeast DC Wednesday afternoon has been identified as 23 year-old Marvin Harvey; 22-year-old Asia Dontrese Moore has been charged with first-degree murder in connection with the case.

MPD identified Harvey and Moore Thursday evening.

Harvey was found stabbed and unconscious at about 2:25 in the afternoon Wednesday in the 4000 block of Blaine Street. A DC Alert indicated that a suspect was on the scene. It is unclear if that message was in relation to Moore.

Arrest Made in Homicide: 4000 Block of Blaine Street, NE

(Washington, DC)-Detectives from the Metropolitan Police Department’s Homicide Branch have announced that an arrest has been made in the fatal stabbing which occurred in the 4000 block of Blaine Street, Northeast.

On Wednesday, July 3, 2013 at approximately 2:25 pm, patrol officers from the Sixth District responded to the 4000 block of Blaine Street, NE for the report of a stabbing. Upon their arrival, they located an adult male, unconscious, suffering from an apparent stab wound. Personnel from DC Fire and Emergency Medical Services transported the victim to a local hospital where he later succumbed to his injuries and was pronounced dead.

The decedent is identified as 23 year-old Marvin Harvey of Northeast, Washington, DC.

On Wednesday, July 3, 2013, uniformed members of the Sixth District arrested 22-year-old Asia Dontrese Moore of Southeast, DC, charging her with First Degree Murder while Armed in connection to the homicide death of Marvin Harvey.
