A <a href="http://homicidewatch.org/2013/02/12/jurors-deadlock-in-murder-case-against-karl-pugh/" >previous jury deadlocked</a> in February. </p> <p>A week before the first trial, Judge Ronna Beck <a href="http://homicidewatch.org/2013/02/02/judge-grants-motion-to-suppress-statements-karl-pugh-made-to-police/" >granted a motion to suppress statements</a> Pugh made to police confessing to the murder, after Pugh's attorney argued that Pugh was high on PCP and that statements made by detectives during the interrogation misled Pugh into thinking that police were there to help him. </p> <p>Ragland said she thought the jury would have found Pugh guilty if his statement to police had been admitted. </p> <p>At the first trial, a witness testified that she, Pugh and Ragland had smoked PCP minutes before Ragland was killed. The witness said that she never saw the shooting.</p> <p>Pugh's fiancé, Denise Carpenter, was in the courtroom Friday for the reading of the verdict; she attended the entirety of both trials. Because the gun was recovered with the wrong type of ammunition in it, investigators decided it was too dangerous to fire the weapon to test it further.</p> <p>Pugh's attorney, Jason Downs, argued someone else had fired the fatal shot, and was still at large. The three of them smoked two “dippers” in Ragland's vehicle outside his apartment complex before going their separate ways. Pugh and Ragland, the witness testified, planned to head into Ragland's apartment.</p> <p>The witness said no argument nor confrontation had occurred in her presence. And when the group separated, Ragland was laughing and joking, but Pugh looked angry, the witness testified. </p> <p>A few minutes later, as she was leaving a nearby grocery market, the witness heard police sirens coming up the street. She never heard a gun shot, according to trial testimony. </p> <p>Police found Ragland lying in the hallway outside his apartment suffering from a single gunshot wound to his eye; his apartment keys were in his left hand. The front door to his apartment was ajar when police arrived on the scene, and a pile of scattered CD's were in the doorway. </p> <p>The gun that was later recovered from a nearby parking lot was a 1910 Colt revolver, which contained the wrong type of ammunition, Truscott said during opening statements. Ragland then retrieved a rust colored revolver, and the two men engaged in a second tussle outside of the apartment, Pugh said. </p> <p>Pugh wrestled the gun away from Ragland and shot him in the face, he told detectives. Pugh then fled the scene and tossed the gun underneath a vehicle in a nearby parking lot before being apprehended by MPD who were patrolling the area.</p> <p>Ragland died from a single close-range gunshot wound to his left eye. </p> <p>Pugh's defense attorney, Jason Downs, argued in his motion that Pugh was “suffering from PCP intoxication at the time of his interrogation, which makes it less probable that Pugh knowingly, intelligently, and voluntarily waived his rights.”</p> <p>Downs further argued that detectives purposely misled Pugh into thinking that they were there to help him.</p> <p>According to the motion to suppress statements, Detective Delauder told Pugh, “I need you to come one hundred percent clean, or I can't help you, all right? It looks better when I go to a judge in the morning and I say, 'Hey look, the man made a mistake.' I'm here to help you, but if you don't want to help yourself, then shame on you.”</p> <p>Downs argued Detective Fultz compounded the problem when he told Pugh, “Give yourself an opportunity, okay? Ragland retrieved a revolver from his apartment, came back outside, and the "tussle" resumed, Pugh told police.</p> <p>Pugh said he wrestled the revolver away from Ragland, but that the revolver fired while he was grabbing it.<br /> <span id="more-5717"></span><br /> Ragland was shot in the face at close range, charging documents state. </p> <p>Pugh fled the scene, but ran into police who were canvassing the area and was taken into custody. Upon arrival, they discovered an unconscious and unresponsive adult male suffering from a gunshot wound.
