The maximum sentence for voluntary manslaughter is 30 years and requires a minimum sentence of five years.<br /> <span id="more-25644"></span></p> <p>Police responded to a shooting on the 500 block of 57th Street Northeast at approximately 10:42 a.m., where they found Davis suffering from gunshot wounds, according to the charging documents. Davis was rushed to Prince George's County Hospital where he was pronounced dead at 11:25 a.m. after life saving efforts failed. </p> <p>At the time of the incident, Proctor was in a rented black Mazda 6 on 57th Street Northeast with a group of people, according to the proffer of facts. They parked in an alley on the 500 block, at which point Proctor and an accomplice got out of the car and approached Davis, who was sitting in the passenger seat of a parked car nearby. </p> <p>According to the proffer, Proctor's accomplice ordered Davis out of the car at gunpoint. The accomplice instructed Davis to lie face-down on the ground.</p> <p>Proctor demanded drugs and money from Davis, and "patted [him] down," charging documents say. The accomplice ordered the driver out of the car and told him to get on his knees and took the driver's wallet, according to the proffer. The driver was kneeling behind Davis.</p> <p>The proffer states that Proctor went through the passenger side of the car and again demanded drugs and money. When Davis told Proctor he didn't have anything else, Proctor shot him in the back multiple times with a silver handgun. Davis died as a result of the gunshot wounds, according to the proffer. He was transported to Prince George’s County Hospital, where he later died of his injuries.</p> <p><a href="http://homicidewatch.org/2013/06/11/maudarico-proctor-dominic-davis/">Charging documents allege</a> that Proctor took a witness’s rental car to 57th Street Northeast in search of Davis to retaliate for another murder.<br /> <span id="more-21891"></span><br /> Proctor and another man, armed with a silver semi-automatic handgun, approached Davis and an unidentified witness in the witness’s car, forcing them out at gunpoint and demanded that they lie down on the ground, according to the prosecution. </p> <p>The men wore ski masks and “patted down” Davis, taking a cell phone, money, and a wallet, according to the witness. The witness said that he got up and ran, but looked back and saw the suspects leave in a black four-door vehicle. </p> <p>Charging documents in the case say police recovered four expended shell casings, two bullets, and multiple bullet fragments from the scene of the shooting.</p> <p>Police searched Proctor’s home less than a month after the murder and seized his cell phone, which contained several photographs that were taken on the evening of January 14 showing Proctor holding a silver handgun. Police also discovered several other photos of Proctor holding a black semi-automatic handgun with a large capacity magazine, documents say. </p> <p>Detective Tyler testified Friday that Proctor's phone records show that the day after the murder he sent text messages trying to sell a Smith and Wesson 9mm handgun that holds 16 rounds. Homicide Watch D.C.'s records show that <a href="http://homicidewatch.org/victims/brian-andre-proctor/" >Brian Andre Proctor</a> was shot and killed at that same location in September 2012; it is unclear whether Mauda'Rico Proctor and Brian Proctor are related. </p> <p>According to the witness, Proctor said that he “went all Wayne Perry” on a guy, and that the only evidence the police had was a black rental car he borrowed from someone else.
