He is suspected of second-degree murder.</p> <p>Davis's attorney argued that the 23-year-old acted in self-defense.</p> <p><a href="http://homicidewatch.org/victims/james-byron-davis/">James Byron Davis</a>, 53, was <a href="http://homicidewatch.org/2014/11/18/fatal-stabbing-monday-victims-nephew-arrested/">found</a> suffering from multiple stabs wounds in the 5000 block of Just Street Northeast. He died at a local hospital.</p> <p>MPD Detective Anthony Paci testified Friday that the uncle's sister told police she and her brother had an argument the night he died. She said her brother accused her of moving a table "with her mind," Paci told the court. He added: "She told me her brother was a paranoid schizophrenic."<br /> <span id="more-26609"></span></p> <p>Paci said James Davis had been carrying a knife all day. During the argument with his sister, he choked her before she "slapped his hand away." </p> <p>She went to check on her younger son, the woman told police. At some point, she heard her older son (Davon Davis) and her brother arguing and saw them struggling over a knife.</p> <p><a href="http://homicidewatch.org/2014/11/18/davon-davis-charged-in-uncles-murder/">Charging documents say</a> that Davis' mother tried to break up the fight, but the two Davis' began punching each other. </p> <p>"The decedent and Defendant backed away from one another and the decedent fell to the floor, and [she] saw the Defendant with the knife in his hand," the police report says. Davon Davis placed the knife in a sink, and his mother called 911.</p> <p>"We don't know how the fight began, but we know how it ended," Assistant U.S. Attorney Michael Spence said. Spence argued that Davis' uncle suffered from over 20 stab wounds, including six to his back.</p> <p>Paci said Davis had "40 stab wounds" and his ear and finger were "almost severed off."</p> <p>Defense attorney Craig Hickein argued that it's up to the government to prove that his client wasn't acting in self-defense.</p> <p>"No evidence shows that my client used any force that wasn't necessary," Hickein said. He was <a href="http://homicidewatch.org/2014/11/18/fatal-stabbing-monday-victims-nephew-arrested/">arrested Monday</a>.<br /> <span id="more-26059"></span></p> <p>Documents say that Davis's mother told police that she and James Davis had an argument over whether or not a table had been moved. According to the mother, Davis claimed he didn't move the table, then grabbed a knife and choked her during the argument, court documents say. </p> <p>Once the argument was over, the mother went upstairs to check on her 12-year-old child. </p> <p>She heard James and Davon Davis arguing and fighting, according to charging documents, and when she went back downstairs, she found the two men struggling over the knife James Davis had brandished earlier.</p> <p>The woman told police that she tried to break up the fight, but the two Davis' began punching each other. "The decedent and Defendant backed away from one another and the decedent fell to the floor, and [she] saw the Defendant with the knife in his hand," the police report says. Davon Davis placed the knife in a sink, and his mother called 911.</p> <p>After he was arrested, Davon Davis told police he had no memory of stabbing his uncle.</p> <p>In an interview, the 12-year-old said it heard "D" and "Byron" arguing downstairs and saw "D" stabbing "Byron" over and over again, according to documents.</p> <p>Davis is scheduled for a preliminary hearing December 19 at 9:30 a.m. before Judge Russell F. His nephew, <a href="http://homicidewatch.org/suspects/davon-davis/">Davon Davis</a>, was arrested on scene.</p> <p>Police found 53-year-old Davis suffering from multiple stabs wounds in the 5000 block of Just Street Northeast at approximately 9:20 p.m. Monday night. Davis was taken to a local hospital, where he later died.</p> <p>The 23-year-old Davis is suspected of second-degree murder while armed. </p> <p>A press release from MPD is after the jump.<br /> <span id="more-26046"></span></p> </blockquote> <p><em>Tuesday, November 18, 2014</p> <p>Arrest Made in the Homicide: 5000 Block of Just Street, Northeast</p> <p>Detectives from the Metropolitan Police Department’s Homicide Branch have announced that an arrest has been made in the fatal stabbing which occurred in the 5000 block of Just Street, Northeast.</p> <p>On Monday, November 17, 2014, at approximately 9:20 pm, police officers from the Sixth District responded to a call for service regarding a stabbing inside of a residence in the 5000 block of Just Street, Northeast. Upon arrival, they located an adult male suffering from multiple stab wounds. DC Fire and Emergency Medical Services personnel transported the victim to a local hospital where he succumbed to his injuries and was pronounced dead.
