Probable Cause Found in Kirk Perry's Death

A judge found probable cause Thursday in the case against Heritage Jones, 21, who is accused of shooting Kirk Deangelo Perry more than 13 times in an argument over a dog on November 30.

According to court documents, Perry's dog lunged at Jones after Jones didn't move out the way when Perry and his dog were passing through.

Perry, 50, was found unconscious and suffering from multiple gun wounds in the 2400 block of Elvans Road Southeast. He died from his injuries at a hospital on December 1.

Based on eyewitness statements, there were three altercations between Perry and Jones, Assistant U.S. Attorney Natalia Medina argued in court. She said when Jones was interviewed he essentially confirmed the witness' version of events except who had committed Perry's murder.

Detective Anthony Patterson testified Thursday that Jones told police that he had three separate arguments with Perry, but he denied being involved in Perry's death.

"Jones said he stepped away and then he heard gunshots," Patterson said. Jones said that during the time of the second argument, Perry flashed a gun at him, Patterson testified.

Jones' defense attorney David Maxted argued that Jones was acting in self-defense.

"What happened was tragic, but really unavoidable," Maxted said. "It started over a comment about a dog. Mr Jones didn't threaten Mr. Perry, but Perry went to retrieve a gun, approached Jones, and flashed a gun at him."

Maxted argued that Jones even told Perry, "You don't threaten me with a gun." He said there is a lack of evidence of Perry doing anything further other than a witness' statement.

According to documents, while watching from an apartment balcony, a witness saw Jones and Perry come together for a third time and saw a muzzle flash between Jones and Perry before Perry fell to the ground. The witness told police it ran down from the apartment near the parking lot and saw Jones fire three or four more times before leaving the area.

There seemed to be three encounters and the third encounter showed "no evidence" of Perry threatening Jones which goes against self-defense, Judge Robert E. Morin said before his ruling.

Jones is scheduled for a felony status conference on February 20, 2015 at 11:00 a.m. before Judge Morin.

Heritage Rickey Jones Charged in Kirk Perry's Death

Kirk Deangelo Perry was shot more than 13 times after a disagreement with Heritage Rickey Jones that began over a dog.

Perry, 50, was found unconscious
and suffering from multiple gun wounds in the 2400 block of Elvans Road Southeast. He died from his injuries at a hospital on December 1.

Jones, 21, was ordered held Thursday on suspicion of second-degree murder while armed. He was arrested Wednesday.

According to charging documents, a witness provided a half statement to police and initially denied knowing who shot Perry. However, after it learned that Perry had died, the witness told police that Perry told it about a verbal argument Perry had with Jones earlier in the day on November 30.

Perry told it that his dog lunged at Jones after Jones didn't move out the way when Perry and his dog were passing through, according to the witness. He told it that Jones then said, "I got a .45 with an extended clip for your dog," documents say. The witness said Perry responded saying: "I got guns too" and went and got a bag from upstairs which it believed contained Perry's gun.

While they were headed to a laundromat, Perry saw Jones wearing all black and staring at them, and Perry pointed Jones out to it telling the witness Jones was the guy who threatened to shoot his dog, according to court documents. The witness told police it had seen Jones around the neighborhood on a daily basis. Three hours later, Perry and the witness returned to the apartment. Perry went upstairs and immediately came back down. Jones approached Perry, leading to an argument, charging documents state. During the confrontation, Perry flashed a silver or gray handgun he had tucked in his front waistband.

According to documents, Jones told Perry, "You don't threaten me with a gun." Perry said he wasn't threatening him, but he didn't want anything to happen to his dog, the witness recounted. Later, Perry went to speak with an unidentified man about talking to Jones, so they could "squash the beef." The man went to speak with Jones. After the conversation, the man told Perry that Jones wanted to talk to him, documents say.

While watching from the apartment's balcony, the witness saw Jones and Perry begin a new conversation and saw a muzzle flash between Jones and Perry before Perry fell to the ground.

The witness told police it ran down from the apartment near the parking lot and saw Jones fire three or four more times before leaving the area. The witness said it didn't see Perry with a gun, but when people tried to help him up, it heard a clank and saw the weapon Perry had flashed earlier.

When officers arrived, they found no weapon on or near Perry, but recovered 14 nine-millimeter shell casings from the scene, documents state.

Jones is scheduled for a preliminary hearing on Dec. 11 at 9:30 a.m. before Judge Robert E. Morin.

Heritage Jones Arrested in Kirk Perry's Murder

A 21-year-old D.C. man was arrested Wednesday for the shooting death of Kirk Deangelo Perry, 50, on December 1.

Police say Heritage Jones is suspected of second-degree murder while armed.

Perry was found unconscious in the 2400 block of Elvans Road Southeast suffering from gunshot wounds. He died a little after midnight at a local hospital.

Arrest Made in Homicide: 2400 Block of Elvans Road, Southeast

(Washington, DC) – Detectives from the Metropolitan Police Department’s Homicide Branch have announced that an arrest has been made in the homicide which occurred in the 2400 block of Elvans Road, Southeast.

On Monday, December 1, 2014, at approximately 12:38 am, police officers from the Seventh District responded to a call for service in connection to a shooting in the 2400 block of Elvans Road, Southeast. Upon arrival, they located an unconscious male outside the incident location, suffering from multiple gunshot wounds. DC Fire and Emergency Medical Services personnel transported the victim to a local hospital where he succumbed to his injuries and was pronounced dead.

The decedent has been identified as 50-year-old Kirk Deangelo Perry, of Southeast, Washington, DC.

On Wednesday, December 3, 2014, an officer from the Seventh District arrested 21-year-old Heritage Jones of Southeast, Washington DC, pursuant to a DC Superior Court arrest warrant, charging him with Murder II while Armed in the shooting death of Kirk Perry.

Midnight Shooting Kills Kirk Deangelo Perry

Kirk Deangelo Perry, 50, died from multiple gunshot wounds shortly after midnight Monday, police said.

Perry was found unconcious in the 2400 block of Elvans Road Southeast, according to police. He died at a nearby hospital.

Detectives from the Metropolitan Police Department’s Homicide Branch are investigating a homicide which occurred in the 2400 block of Elvans Road, Southeast.

On Monday, December 1, 2014, at approximately 12:38 am, police officers from the Seventh District responded to a call for service in connection to a shooting in the 2400 block of Elvans Road, Southeast. Upon arrival, they located an unconscious male outside the incident location, suffering from multiple gunshot wounds. DC Fire and Emergency Medical Services personnel transported the victim to a local hospital where he succumbed to his injuries and was pronounced dead. The decedent has been subsequently transported to the Office of the Chief Medical Examiner for the District of Columbia where an autopsy will be performed to ascertain the cause and manner of death.

The decedent has been identified as 50-year-old Kirk Deangelo Perry, of Southeast, Washington, DC.

The Metropolitan Police Department currently offers a reward of up to $25,000 to anyone that provides information which leads to the arrest and conviction of the person or persons wanted for any homicide committed in the District of Columbia.
