Substantial probability was found today in the case against Anthony Hatton, who is suspected of gunning down teen Tyrell Fogle in Northeast DC in August.
Two MPD officers witnessed the shooting and chased Hatton through the neighborhood. Hatton eventually dropped a gun, put his hands up, and came out of some bushes where he was hiding, Detective Alfred Thomas Austin-Braxton testified Wednesday.
Hatton, 18, is suspected of first-degree murder while armed.
Austin-Braxton said the witnessing officers saw Fogle run across a residential street in the Langston Terrace neighborhood, then saw Hatton chasing after him, his arm outstretched and holding a gun. Fogle was struck by bullets three times, each of the bullets entering his back.
There is no evidence that anyone else was shooting any weapon while Hatton was shooting and Fogle was unarmed, Austin-Braxton said.
“That’s a pretty brazen act,” Judge Thomas Motley said of the facts of the case as presented Wednesday. Motley ordered Hatton held pending an indictment from the Grand Jury.
Hatton’s defense attorney, Jia Cobb, had argued for Hatton’s release. She said Hatton’s family was in the courtroom for the hearing, that he had no drug history and little criminal history, and that he is involved with GED and Bible study classes at a local community center.
A trial date is set for July 23, 2012.
