Judge Lynn Leibovitz dismissed all charges against James Sandidge Tuesday after prosecutors decided not to take the case to trial for a third time.
In his first trial, 11 of the 12 jurors were prepared to convict Sandidge of manslaughter in connection with the October 2011 shooting death of Keenan Jerel Lee. But in the second trial, ten of the 12 jurors were prepared to acquit Sandidge on the lesser count of second-degree murder.
Sandidge has been held since October 2011 in connection with Lee’s death.
Defense attorney Jonathan Zucker said that Sandidge will need to complete paperwork for courts in DC and Maryland, “But he will be able to go home.”
